Terms and Conditions
These terms govern the relationship between Heirlight and persons who engage our archival and heritage education services. Please read them carefully before booking an appointment or placing an order.
1. Interpretation
In these Terms, "Heirlight", "we", "us", and "our" refer to Heirlight, a heritage documentation and archival education studio operating from 22 Jalan Burma, 10350 George Town, Penang, Malaysia. "Client", "you", and "your" refer to any individual or family group who engages our services or uses our website.
"Services" refers collectively to the Personal Letter and Photograph Archive programme (ARC-01), Heritage Conversation Sessions (HCS-02), the Inventory Sheet Service (INV-03), and any other archival or educational programmes we offer from time to time.
These Terms apply to all engagements, whether initiated in person at our studio, by telephone, or through our website at heirligh.pro. By booking a service or submitting an enquiry form, you confirm that you have read and accept these Terms.
2. Our Services
2.1 Nature of Services
Heirlight provides archival, administrative, and educational services only. Our work is concerned with the physical organisation, cleaning, documentation, and catalogue production of personal papers, photographs, and household items.
We do not provide legal advice, estate administration, financial planning, or any other service requiring a regulated professional qualification. Nothing we say, write, or produce should be understood as legal or financial advice. If you require such advice, please consult a qualified professional.
2.2 Service Descriptions
Full descriptions of each service — including scope, deliverables, and current pricing — are set out on our website and in our studio literature. We reserve the right to adjust service descriptions and pricing, and we will notify you of any change before confirming your booking.
2.3 Availability
Our studio is open Tuesday to Friday, 10:00 am to 5:00 pm, and Saturday, 10:00 am to 2:00 pm. We are closed on Sundays and Mondays and on Malaysian public holidays unless otherwise communicated. Appointment slots are subject to availability.
3. Bookings and Fees
3.1 How to Book
Bookings may be made by telephone at +60 4-228 6294, by email at [email protected], or by submitting the enquiry form on our website. A booking is confirmed only when we send you a written confirmation by email or letter.
3.2 Fees
Current service fees are as follows:
- Personal Letter and Photograph Archive (ARC-01) — RM 2,650
- Heritage Conversation Sessions (HCS-02) — RM 380 per person
- Inventory Sheet Service (INV-03) — RM 720
All fees are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise. Fees are payable in full at the time of confirmation or at the first studio appointment, as agreed at booking.
3.3 Payment
We accept payment by bank transfer, cash, and such other methods as we communicate from time to time. Receipts are issued for all payments.
4. Cancellation and Rescheduling
4.1 By You
You may cancel or reschedule a confirmed appointment by giving us at least five working days' notice by telephone or email. Cancellations with five or more working days' notice will receive a full refund of any advance payment made. Cancellations with fewer than five working days' notice may be subject to an administration charge not exceeding RM 150, which we will communicate to you at the time.
For the Heritage Conversation Sessions, individual participants within a group booking may transfer their place to another adult attendee at no charge with prior notice.
4.2 By Heirlight
We reserve the right to cancel or reschedule an appointment in the event of circumstances beyond our reasonable control, including but not limited to public holidays, studio closure, or unavailability of our facilitators. In such cases, we will notify you as early as practicable and offer a full reschedule or refund of any advance payment.
5. Your Materials
5.1 Ownership
All physical items — including letters, photographs, documents, and objects — that you bring to our studio remain your property at all times. We hold them only for the duration of the work agreed and return them to you upon completion.
5.2 Care
We handle all materials with care using standard archival practices. We work in a controlled studio environment and store items securely between appointments. We will inform you promptly if any item shows signs of fragility or deterioration that may affect our handling approach.
5.3 Limitation
We are not insurers of your materials. We are not liable for pre-existing deterioration, inherent fragility, or damage arising from conditions that could not have been prevented by reasonable care. We recommend that items of significant personal importance are discussed with us before their first studio visit so that we can agree on an appropriate handling plan.
5.4 Digital Copies
Where our services include the creation of digital scans or catalogue files, we will deliver the agreed outputs to you on the agreed medium. We do not retain copies of your materials beyond the period necessary to complete the work, unless you ask us in writing to hold a working copy for a follow-up appointment.
6. Conduct at Our Studio
We ask all clients and accompanying persons to treat our staff and studio with courtesy and respect. We reserve the right to end a session and ask a person to leave if conduct is disruptive, threatening, or causes distress to staff or other clients. In such circumstances, no refund of any session fee already incurred will be made.
Photography within the studio for personal or non-commercial purposes is permitted. Commercial photography or recording requires our prior written consent.
7. Intellectual Property
All original content on our website and in our printed materials — including text, layout, and design — is the property of Heirlight or is used under licence. You may not reproduce, adapt, or distribute this content without our prior written permission.
The catalogue documents, inventory sheets, and session workbooks we produce as part of our services are provided for your personal and family use. You may share them within your family but may not reproduce or distribute them commercially.
Ownership of copyright in original family documents, photographs, and letters remains as it stands under applicable Malaysian law. We make no claim to ownership of any materials you bring to us.
8. Limitation of Liability
To the extent permitted by Malaysian law, Heirlight's total liability to you in connection with any one engagement shall not exceed the total fees paid by you for that engagement.
We are not liable for any indirect or consequential loss arising from our services, including loss of opportunity, loss of anticipated outcome, or distress arising from the contents of documents we handle.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any matter where liability cannot lawfully be excluded.
9. Privacy
We collect and hold personal information in accordance with our Privacy Policy and the Malaysian Personal Data Protection Act 2010. By engaging our services, you acknowledge that you have read our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, pricing, or applicable law. The current version will always be published on our website with the date of last update. Changes take effect from the date of publication and apply to bookings made after that date. Bookings confirmed before a change are governed by the Terms in force at the time of confirmation.
These Terms are governed by the laws of Malaysia. Any dispute will be subject to the jurisdiction of the courts of Malaysia.
